Hong Kong and Macau Residents

I have resided in ROC for a certain period of time, can I apply for permanent residence?

一、 Laws and regulations: Policies for entry and residence permit of people of Hong Kong or Macau who wish to enter ROC.
二、 Suitable candidate:Applicants and accompanying spouse and underage children with direct relatives, spouse, siblings or parents-in-law in ROC with household registry who have resided in ROC for a certain period of time as per the Policies for entry and residence permit of people of Hong Kong or Macau who wish to enter ROC article 17, clause 1 and article 1, clause 7, 8, 10, and 13, may apply for residence still if his/her direct relatives, spouse, siblings or parents-in-law is deceased during the applicant’s stay in ROC according to clause 1 of the same article.
三、 Required documents:
(一) An application form for people of Mainland China entering ROC with all the details filled. Please attach a 4.5x3.5cm in full color ID photo taken within 2 years without hat (same dimension as the ID photo).
(二) Original and copy of the Permanent ID of Hong Kong or Macau. The original copy will be returned after verification.
(三) ROC residence permit or ROC entry/exit permit.
(四) Health examination certificate (A health examination report as per the requirements of the Department of Health. The report must be issued within 3 months). The health report is not required if the party is below the age of 6 but a copy of the vaccination report must be attached.
(五) Child born out of wedlock must first be adopted and the DNA report and prove of status during pregnancy must be provided. If the pregnancy occur before the marriage, the DNA report and prove of status during pregnancy must be authenticated by the by Taipei Economic and Cultural Office in Hong Kong or Macau, or a ROC embassy. (The gestation period may be calculated as day 181~302 prior to the date of birth) (This is not required if it has already been provided during the residency application).
(六) Authorization letter: An authorization letter must be provided if a representative is appointed and the letter must be signed or stamped by the representative personally. The application form must be signed or stamped by a representative of the travel agent if a travel agent is employed for the delivery of the application. An authorization letter is not required if a travel agent is employed.
(七) Permit fee: NT$600
(八) Please provide a registered return mail envelope with the recipient’s name and address, postal code, and telephone number.

(十) Authentication certificate for Hong Kong or Macau Identity.
四、 Attention:
(一) Applications according to the principle of dependence via marriage or adoption must be retained for at least 3 years. This is not applicable to those born within the marriage period.
(二) The new date of residency for those who alter the reason of residency during stay in ROC according to the policies for entry and residence permit of people of Hong Kong or Macau who wish to enter ROC article 22, clause 2, will take effect starting from the day of approval. (The initial date of residency and the residency period granted during initial application will be applicable to applicants applying via policies for entry and residence permit of people of Hong Kong or Macau who wish to enter ROC article 17, clause 1).
(三) Residence in ROC for a certain period of time is defined as:
1. Resided in ROC for at least 1 year without leaving the country for more than 30 days prior to the application time. The applicant is allowed to leave the country for 30 days each year and the number of departures will not be taken into consideration. The calculation beings on the day of departure and those leaving and entering the country on the same day will be calculated as 1 day. Departures and residence appointed by a government sector will not be taken into account.
2. Resided in ROC for at least 2 years and have resided in ROC for at least 270 days per year prior to the application.
(四) According to the policy for residents of Hong Kong or Macau entering and residing in ROC article 5, clause 1 and 2: application to enter or reside in ROC with missing documents must be provided within 3 days after receiving the notification. The application will be denied if the applicant fails to do so or the provided documents do not meet the requirements.
