FAQ of investment in Taiwan

Q. How do overseas chinese or foreign nationals apply for investment in Taiwan?
A. Overseas chinese or foreign nationals who wish to invest in Taiwan are required to file an application to the Investment Commission under the Ministry of Economic Affairs (MOEA) in accordance with the Statute for Investment by Overseas Chinese or Statute for Investment by Foreign Nationals. 
Upon approval, the application party must register the company with the company registration authority in accordance with the Company Law. Those who wish to establish a branch company must seek approval from the MOEA Central Region Office.
Q. Which government organization should Overseas Chinese or foreign nationals contact for inquiry on investment in Taiwan?
A. Overseas Chinese or foreign nationals who wish to invest in Taiwan should contact the Accountant Service Center or the 1st Division of the Investment Commission, Ministry of Economic Affairs for inquiry.

Q What documents should foreign nationals or overseas Chinese prepare in order to apply to invest in Taiwan??
A. Please prepare the following documents:

I. Application Form

II. Identity Certificate of investor:


1.
Overseas Chinese: Overseas Chinese identification documentation issued by the Overseas Chinese Commission.


2.
Foreign Nationals: A copy of the national identity certificate or valid passport; corporate entity or juridical personnel accreditation issued by the local government. The local government may request authentication by the foreign embassy or representative office in Taiwan if necessary.

III.
Original copy of the authorization letter for investor representative and a copy of the representative’s ID card:

The representative must be a citizen of the Republic of China. Public servants, government employees and teachers, or active military personnel are not allowed to serve as the investor’s representative.


2.
If the investor is a corporation juridical person, a representative must be nominated.


3.
The investor’s representative authorization letter must be authenticated by the local government agency or court, notarized by a qualified public notary authority according to the ROC Notary Act, authenticated by the respective foreign embassy or representative Office in ROC, or authenticated by the ROC Embassy or Representative Office in the country of origin. The content of the authorization letter should state the name of the investor and the representative, and should state the obligations designated therein to the representative.

IV.
A copy of the intended issues of the registered company. Newly established businesses are required to submit original copies of pre-registration forms.
Q. What are the premiums available to foreign companies investing in technology research and development in ROC?
A.
Foreign companies when coming to invest in Taiwan may apply, according to the regulations, to the Ministry with proposals for R&D funding. The Ministry's Industrial Technology Task Force is set up to encourage businesses to conduct business innovation, applied research, strengthening business R&D capabilities and mechanisms as well as promoting the development of the knowledge service sector. The Ministry also, from time to time, updates its various funding plans based on the changes among domestic companies. Q. How do overseas chinese or foreign nationals apply for the employment of necessary foreign employees?
A. Upon the approval of the investment and establishment of companies, the alien resident or foreign national should apply for a work permit from the Council of Labor Affairs, Executive Yuan with the relevant documents.For detailed information on applying for a work permit, visit the website of the Workforce Development Agency or call (02)8995-6000.
Q. How can foreign investors acquire land in Taiwan?
A.
