What to do in case of employer-employee dispute when working in Taiwan?

In case of any dispute in relation to labor contract or workers’ right during foreigners’ work period in Taiwan, a request for mediation or assistance may be filed with the Council of Labor Affairs of the Executive Yuan or the Consultation Service Center for Foreign Worker of each county/city.

I. Consultation Service Center for Foreign Worker
To provide timely assistance to foreign workers in Taiwan with regard to their living, work, legislation consultation and complaint and to assist with the resolution of employer-employee disputes, the Council of Labor Affairs of the Executive Yuan has set up 22 Consultation Service Centers for Foreign Worker in various locations throughout the country. These centers hire bilingual consultants who speak English, Thai, Indonesian and Vietnamese, providing complaint and consultation services to foreign workers. Any foreign worker with any need for complaint or consultation can go to the local Consultation Service Center for Foreign Worker or contact the bilingual foreign worker consultants by telephone or in writing. These centers provide the following services:
1. Provide foreign workers with living information, legislation consultation services and necessary religious assistance.
2. Assist with the provision of translation in the native languages of foreign workers.
3. Visits and legislation promotion in factories (and factory employers).
4. Administration of foreign workers’ leisure activities and other administration assistance related matters.
II. Labor Competent Authority of Each County/City
The labor competent authority of each county/city provides the following services:
1. Mediation of Employer-Employee Disputes: The Consultation Service Center for Foreign Worker assists with the resolution of labor disputes between foreign workers and employers and collection of foreign worker’s salaries, broker fees, reserve funds and tax refunds illegally withheld by the employers.
2. Placement of Foreign Workers: In case of improper treatment by employers or if the employers cannot take care of foreign workers properly due to improper treatment or closure of factory or suspension of business, the local labor competent authority can place the workers in nearby placement organizations.
III. Representative Offices of Foreign Workers in Taiwan
In case of any emergency, occurrence of employer-employee dispute or event of sexual harassment, foreign workers can also contact the representative offices of the exporting countries of the foreign workers in Taiwan to seek assistance. Upon receipt of the request, these offices will transfer the matters to the Council of Labor Affairs of the Executive Yuan.
IV. 1955 24-Hour Foreign Worker Consultation and Protection Hotline
To provide foreign workers and the general public with a hotline number that is easy to remember and to dial and to strengthen the network of consultation and complaint for foreign workers, the Council of Labor Affairs of the Executive Yuan set up the “Foreign Worker 24-Hour Consultation and Protection Hotline 1955” on 1 July 2009, providing 24-hour, all-year-round, free-of-charge professional services. In addition to services in Chinese, the hotline also provides consultation services in the native languages of foreign workers, in English, Thai, Indonesian and Vietnamese.
